1. Acceptance of Terms

By accessing or using the services provided by Apex Growth Co. ("we," "our," or "us"), you (“Client” or “you”) agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services Provided

Apex Growth Co. offers digital marketing and lead generation services for garage door repair and installation companies, including but not limited to:

Facebook & Google advertising AI-powered appointment booking Lead capture and CRM automation Retargeting & remarketing campaigns Consulting and analytics

Specific service deliverables will be outlined in a signed service agreement or invoice.

3. How We Collect Information

We gather data through:

Contact or lead forms submitted on https://apexcoagency.comSMS opt-ins (e.g., texting START to our number)Client onboarding forms Analytics and cookies (via third-party platforms like Google and Facebook Ads)

3. Client Responsibilities

Clients are responsible for:

Providing accurate business information and approvals in a timely manner Managing follow-up on leads delivered (if outside of our follow-up scope)Complying with local advertising laws and business regulations Ensuring appropriate licensing to operate their garage service company

Failure to provide necessary materials or approvals may delay results and is not grounds for a refund

4. Fees & Payment Terms

Clients agree to pay all fees as outlined in the invoice or subscription. Payment terms:

Monthly Retainers are billed in advance Performance-Based Fees (e.g., pay-per-appointment or lead bonuses) are billed weekly or per occurrence Late payments are subject to a 5% late fee per 10 days overdue

We reserve the right to pause or terminate service for non-payment.

5. Lead Guarantees (If Applicable)

If a lead or appointment volume guarantee is offered in writing (e.g., "10 leads in 30 days or we pay you $50 per missed lead"), it applies only if:

The client actively follows up with leads The client does not reject qualified leads based on personal preferences The client has not paused, altered, or canceled the campaign during the period

Refunds or compensation will only be honored according to the signed agreement terms.

6. Refund Policy

Due to the nature of digital services and ad spend, all payments are final unless stated otherwise in writing. No refunds will be provided for partial months of service, unused portions, or dissatisfaction due to factors outside our control (e.g., market conditions, client response delays).

7. Data Collection & Privacy (CCPA Compliance)

We collect limited personal data (e.g., name, phone, email) to generate leads and deliver services.

In accordance with the California Consumer Privacy Act (CCPA) :

8. Intellectual Property

All campaign assets, creatives, ad copy, and workflows built by Apex Growth Co. remain the intellectual property of Apex Growth Co. unless explicitly transferred via contract.

Clients may not reuse or redistribute materials without written permission.

9. Limitation of Liability

Apex Growth Co. is not liable for:

Loss of revenue from client-side issues (e.g., failure to close leads)Technical failures beyond our control (e.g., Facebook/Google outages)Indirect, incidental, or consequential damages arising from our services

Our total liability is limited to the amount paid by the client for the month of the issue.

10. Termination

Either party may terminate the agreement with 7 days' written notice

We reserve the right to terminate immediately for non-payment, abusive behavior, or violation of these terms.

11. Governing Law

These terms are governed by the laws of the State of California

Any disputes arising from this agreement shall be resolved in Alameda County, California

12. Changes to Terms

We may update these Terms of Service at any time. Continued use of our services after changes are posted constitutes acceptance of the new terms.
